Maternity and Parental leave

6.01-Definitions

Maternity leave---a period of absence from work granted to a mother before and after the birth of her child. (http://dictionary.reference.com/browse/maternity+leave)

Parental Leave-- a leave of absence from a job for a parent to care for a new baby. (http://dictionary.reference.com/browse/parental%20leave?s=t)

6.02-Requirements for Maternity Leave

Pregnancy leave will be granted in accordance with the provisions of the Employment Standards Act, except where revised in this provision.

  1. Employee should be employed for the company 13 weeks prior to the date of the baby is expected to be born (employment legislation) however, if situation is crucial and a leave is essential even if the 13 week period has not been achieved, changes can be made.
  2. The employee shall give written notification at least two (2) weeks in advance of the date of commencement of such leave and the expected date of return. At such time she shall also supply the company with the certificate of a legally qualified medical practitioner stating the expected birth date. She will be entitled for a (17) week maternity leave.
  3. The employee should provide a written notice at least (2) weeks prior to the expected date of return.
  4. When she feels the need is there for the leave to be taken, she should be allowed to do so, without any delay. Therefore, if the mother wants to change the date of the leave at any given time she is eligible and should just provide a notice (2) week prior to the change in date of the leave.
  5. If the baby is not born during the (17) week maternity leave, the leave will end at the birth of the baby and the parent will be entitled to take a parental leave right after the birth of the baby.
  6. Seniority, benefits, vacations, pension plan will continue as they would if employee were to be at work.
  1. Employee will be given a (17) weeks unpaid leave for the maternity leave. However, the casino will provide her 90% of the salary as a benefit for the (2) week waiting period until you get your Employment insurance only if you have worked for the casino for more than a year. For the next (13) weeks will pay the difference between the EI benefits and the (95) percent of salary.

6.03-Requirements for Parental leave

Parental leaves are allowed when the following requirements under the Employment legislation are fulfilled:

  1. An employee who is a parent of a child and who has been employed at the casino for at least (13) weeks is allowed to get an unpaid parental leave either at the birth of the baby or just before the child coming into parents’ custody for the first time. For this leave both parents are eligible
  2. Birth mothers are allowed up to (35) weeks while birth fathers, same-sex partners, and adoptive fathers are entitled up to (37) weeks of parental leave.
  3. If an employee has taken maternity leave, she will be allowed to take parental leave but either towards the end of her maternity leave or once the baby arrives and comes into her custody.
  4. For birth fathers, parental leave must be taken right away or within (52) weeks of the birth of the baby or when it first comes into custody of the parent.
  5. If the employee has been working for more than (1) year at the casino he/she is entitled for the company’s benefit plan, which pays the employee 90% of the salary for the waiting period for the employment insurance.
  6. For the next (8) weeks will pay the difference between the EI benefits and the (95) percent of salary.
  7. Employee entitled for the parental leave must also provide a (2) week notice prior to the leave
  8. If after given the notice the employee wants to change the date of the leave to an earlier date or move it forward can do so by providing a (2) week notice.
  9. If the birth of the child has arrived earlier than the expected date the employee is entitled to take the leave by then has (2) weeks to submit a written statement as to the intention of the leave.
  10. Seniority, benefits, vacations, pension plan will continue as they would if employee were to be at work.
